Welcome to JustRollerShades.com. JustRollerShades.com is operated by New Port Blinds, Inc. The terms “we,” “us,” and “our” refer to JustRollerShades.com and New Port Blinds, Inc.

We operate this website and store, including its information, content, features, tools, products, and services. Shopify provides the ecommerce platform that enables us to offer these services.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when using our website or purchasing our products. By visiting, interacting with, or using our website, or by placing an order, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy, and Shipping Policy.

If you do not agree to these terms and policies, you should not use our website or purchase our products.

SECTION 1: ACCESS AND ACCOUNTS

By using this website, you represent that you are at least the age of majority in your state or province of residence.

You may be asked to provide information including your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you are authorized to provide and use it.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

SECTION 2: PRODUCTS AND PRODUCT CHARACTERISTICS

We make reasonable efforts to describe and display our products accurately. However, colors and product appearance may vary depending on the screen, device, lighting, and settings used to view the website. Customers are strongly encouraged to order material samples before purchasing custom shades.

Minor variations in fabric color, weave, texture, opacity, or dye lot are normal and are not considered defects.

The overall shade width and visible fabric width may differ because space is required for brackets, controls, motors, and other operating components. A product is not defective when these differences are consistent with the applicable product specifications and measuring instructions.

Roller shades installed inside a window opening normally have light gaps along the sides. Room-darkening material reduces incoming light but does not guarantee complete darkness unless the product is specifically represented as a complete blackout system.

Solar shade visibility and privacy change according to lighting conditions. Solar shades generally provide greater daytime privacy when the exterior is brighter than the interior. At night, visibility may reverse when interior lights are on.

Product descriptions, specifications, options, prices, and availability may change without notice. We may discontinue products or limit quantities available to a person, location, or jurisdiction.

SECTION 3: CUSTOM ORDERS

Every shade is custom-made using the measurements, materials, colors, lift systems, control locations, roll directions, mounting choices, valances, bottom rails, motorization options, quantities, and other specifications selected by the customer.

Before placing an order, the customer is responsible for reviewing and confirming every order specification and following our measuring instructions.

JustRollerShades.com is not responsible for products that do not fit because of incorrect customer measurements, incorrect selections, misunderstood options, failure to follow measuring or installation instructions, or changes to the window or installation area.

A product that matches the specifications submitted with the order is not defective because it does not fit, the customer changes their mind, or the customer does not like a selected color, material, opacity, texture, or operating option.

By completing checkout, the customer confirms that all order specifications have been reviewed and approved and acknowledges that the products will be manufactured according to those specifications.

SECTION 4: ORDER ACCEPTANCE, CHANGES, AND CANCELLATIONS

Placing an order is an offer to purchase. We may accept, reject, or cancel an order for reasons including suspected fraud, payment problems, pricing errors, product availability, shipping limitations, or an inability to manufacture the product safely or according to the requested specifications.

An order is accepted after payment has been authorized and we confirm that the order can be produced.

Cancellation or change requests must be submitted by email to justrollershades@gmail.com within three hours of placing the order. The request must include the customer’s name, order number, and requested change or cancellation.

After three hours, an order may enter production and cannot be changed, canceled, returned, exchanged, or refunded except as expressly provided in our Return and Refund Policy or required by law.

If we reject or cancel an order, we will attempt to notify the customer using the contact information provided with the order and will issue any refund that is due.

SECTION 5: FINAL SALE AND CLAIMS

Because our shades are custom-made and cannot normally be restocked or resold, all sales are final except when a product is damaged during shipping, defective, or manufactured incorrectly by us.

Claims involving visible shipping damage, missing items, incorrect products, or manufacturing errors must be reported within seven calendar days of the carrier’s recorded delivery date. Claims must include the order number, a description of the issue, and clear photographs or video.

Customers must retain the product and packaging while a claim is reviewed. A visibly damaged or incorrect product should not be installed.

Approved claims will be handled according to our Return and Refund Policy. Depending on the issue, we may repair the product, provide replacement parts, remake the affected product, or refund the affected product.

A remake will use the original accepted order specifications. A claim cannot be used to request different measurements, colors, materials, or options.

SECTION 6: PRICES, BILLING, AND PAYMENT

Prices, promotions, and discounts may change without notice. The price charged will be the price shown when the order is placed and confirmed in the order confirmation.

Unless otherwise stated, product prices do not include taxes or shipping charges. Applicable charges will be displayed during checkout.

You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the payment method submitted and that charges associated with the order will be honored.

We may correct pricing, calculation, or listing errors. If an error affects an order already placed, we may contact the customer for approval of the corrected amount or cancel and refund the order.

SECTION 7: SHIPPING AND DELIVERY

Orders are subject to our Shipping Policy.

Most orders are manufactured and prepared for shipment within 7 to 10 business days. Additional time may be required when a particular material, color, or matching dye lot must be ordered or replenished.

A flat shipping charge of $39.95 applies to orders shipped within the 48 contiguous United States. Alaska, Hawaii, U.S. territories, and international destinations require confirmation of availability and a separate shipping quote.

Orders normally ship through UPS. Estimated transit time after shipment is approximately 3 to 7 business days.

Delivery dates are estimates. If an unexpected production delay prevents us from shipping within the stated timeframe, we will notify the customer, provide a revised estimate, and provide any options required by applicable law.

An order is considered delivered when the carrier records delivery to the address provided with the order. Responsibility for theft, loss, or damage occurring after confirmed delivery is governed by our Shipping Policy and applicable law.

SECTION 8: INSTALLATION AND USE

Customers are responsible for determining whether a product is suitable for the intended location and for following all measuring, installation, operation, charging, maintenance, cleaning, and safety instructions.

Installation should be performed by a person who is qualified and physically able to complete the work safely. Customers are responsible for selecting suitable mounting locations and appropriate fasteners for the surface involved.

We are not responsible for damage caused by improper measurements, improper installation, unsuitable fasteners, alteration, misuse, abuse, improper cleaning, failure to follow instructions, unauthorized repair, or installation by a third party.

Unless expressly agreed in writing, product prices do not include measuring, installation, removal, electrical work, construction, repair, travel, or third-party labor.

SECTION 9: OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications, integrations, payment services, or other services operated by third parties. We do not control these third-party services.

Third-party tools are provided on an “as is” and “as available” basis. Your use of them is at your own risk and may be governed by separate terms and privacy policies.

SECTION 10: THIRD-PARTY LINKS

Our website may contain links to websites operated by third parties. We are not responsible for the content, accuracy, availability, products, services, security, or practices of third-party websites.

Review the applicable third-party terms and policies before completing a transaction. Questions or claims involving a third party’s products or services should be directed to that third party.

SECTION 11: RELATIONSHIP WITH SHOPIFY

JustRollerShades.com is powered by Shopify, which enables us to provide our website and ecommerce services. However, purchases made through our store are made directly with JustRollerShades.com, not Shopify.

By using our services, you acknowledge that Shopify is not responsible for any aspect of a sale between you and JustRollerShades.com, including any injury, damage, or loss resulting from purchased products or services. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with JustRollerShades.com to the extent permitted by law.

If you submit reviews, photographs, suggestions, feedback, ideas, or other content, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, and distribute that content for operating, improving, and promoting our business and services.

You represent that you own or have permission to submit the content, that the content is accurate, and that it does not violate another person’s rights or applicable law.

We may remove content that we reasonably believe is unlawful, deceptive, abusive, defamatory, obscene, infringing, or otherwise inappropriate.

SECTION 14: ERRORS, INACCURACIES, AND OMISSIONS

Our website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times, or availability.

We may correct errors, update information, or cancel affected orders. If we cancel an order because of an error, we will refund the amount paid for the canceled order.

SECTION 15: PROHIBITED USES

You may use our website only for lawful purposes. You may not use it to:

Violate any applicable law or regulation.
Infringe intellectual property, privacy, or other legal rights.
Submit false, misleading, fraudulent, abusive, or unlawful information.

An agent may not conceal its automated nature, imitate human behavior to evade detection, bypass CAPTCHAs, circumvent access controls, or continue accessing services after being instructed to stop.

We may use technical measures to limit or block automated access.

SECTION 17: INTELLECTUAL PROPERTY

The website and its content, including text, designs, photographs, graphics, videos, logos, product names, software, and arrangement, are owned by or licensed to JustRollerShades.com and are protected by applicable intellectual property laws.

These terms allow personal, noncommercial use of the website. You may not reproduce, distribute, modify, publicly display, republish, store, sell, or transmit protected content without prior written permission.

JustRollerShades.com names, logos, product names, designs, and slogans may not be used without written permission. Shopify’s names and trademarks belong to Shopify. Other names and trademarks belong to their respective owners.

SECTION 18: TERMINATION

We may suspend or terminate access to the website when we reasonably believe a user has violated these terms, engaged in fraudulent or unlawful activity, threatened another person, or created a security or operational risk.

Termination does not eliminate payment obligations or other responsibilities arising before termination.

Provisions concerning intellectual property, payment obligations, disclaimers, liability, indemnification, governing law, and other terms that should reasonably survive will continue after termination.

SECTION 19: DISCLAIMER OF WARRANTIES

Except for any express written product warranty we provide, and to the fullest extent permitted by law, the website, its content, and its services are provided on an “as is” and “as available” basis.

We do not guarantee that website access will always be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not permit the exclusion of certain warranties. Any exclusion in these terms applies only to the extent permitted by applicable law. Nothing in these terms excludes a warranty or consumer right that cannot legally be excluded.

SECTION 20: LIMITATION OF LIABILITY

To the fullest extent permitted by law, JustRollerShades.com, New Port Blinds, Inc., Shopify, and their respective owners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products.

This includes lost profits, lost revenue, loss of data, loss of use, third-party labor, removal costs, installation costs, travel, or damage caused by improper measurement, installation, alteration, operation, maintenance, or use.

To the fullest extent permitted by law, our total liability relating to a product will not exceed the amount paid for the affected product.

These limitations do not apply where prohibited by law.

SECTION 21: INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless JustRollerShades.com, New Port Blinds, Inc., Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal costs arising from your unlawful use of the website, violation of these terms, or infringement of another person’s rights.

SECTION 22: PAYMENT DISPUTES

If you believe a charge, product, shipment, or refund is incorrect, contact us promptly so we can investigate and attempt to resolve the issue.

Initiating a payment dispute does not change the custom-made status of an order or create eligibility for cancellation, return, exchange, or refund.

Nothing in these terms eliminates any lawful right to dispute a transaction. When responding to a payment dispute, we may provide the financial institution with relevant order specifications, customer acknowledgments, policy records, communications, production information, photographs, shipment tracking, and proof of delivery.

SECTION 23: SEVERABILITY

If any provision of these terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed when necessary. The remaining provisions will continue in effect.

SECTION 24: WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms of Service and the policies incorporated into them constitute the agreement governing use of the website and purchases from JustRollerShades.com. They supersede prior communications concerning the same subject unless a separate written agreement signed by us expressly states otherwise.

SECTION 25: ASSIGNMENT

You may not transfer your rights or obligations under these terms without our written consent.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale, reorganization, financing, or transfer of business assets, subject to applicable law.

SECTION 26: GOVERNING LAW

These terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.

To the extent permitted by law, legal proceedings relating to these terms or purchases from us will be brought in the appropriate state court located in Pasco County, Florida, or the applicable federal court in the Middle District of Florida.

Nothing in this section deprives a consumer of a protection or forum that cannot legally be waived.

SECTION 27: CHANGES TO THESE TERMS

The current version of these Terms of Service will be posted on this page.

We may update these terms by posting a revised version. Material changes will apply according to applicable law. The terms in effect when an order was placed will continue to govern that order unless the parties agree otherwise or a change is required by law.
